2.    THE REQUISITES YOU NEED TO MEET IN ORDER TO PROVIDE YOUR PERSONAL DATA

2.1. Minimum age. In order to be able to provide us with your personal data, you must be at least 14 years of age, and/or, where appropriate, be of sufficient legal capacity to use this Website. 2.2. Truthfulness. When you provide us with your data to use our services, you guarantee that the data you provide is real, true, up to date and, in addition, belongs to you and not to third parties. What’s more, you are obliged to notify us of any modification that may occur in the data provided, and, in any event, be responsible for the truth and accuracy of the data provided at all times. 2.3. Control of age and truthfulness. From Tixalia, we reserve the right to verify your age and the identifying information at any time, where necessary, even requiring you to provide an offical supporting document or equivalent procedure  and, in the event of fraud detection whereby it is proven or suspected that your are younger than the age specified, to delete, temporarily deactivate and/or cancel your account.

What data do we gather? Identifying and contact data. We gather your identifying data (name and surnames) and email, as well as any other information you voluntarily include in the communications you send to us. We can request additional information if it is necessary so as to comply with your request or requirement.
What are the purposes of personal data processing? Respond to your requests. The main purpose of this data processing is to be able to respond to your requests, settle your doubts and/or provide you with the required information, as well, where applicable, keep  track of your requests.
What is the lawful basis which allows us to process your data? Is it obligatory to provide these data? Consent. The data provided for the abovementioned purposes will be processed on the basis of consent, granted voluntarily. You can contact us by the means available to request further information or make any request. All the information gathered by the customer service will be processed for statistical purposes which will help us improve the quality of the customer service provided. This purpose is considered to be compatible with the initial one. The information you will be required to provide obligatorily is indicated with an asterisk or similar. Without said information, it will not be possible to deal with your queries or requests.
How long do we keep your information? All the personal information will be kept for the period of time in which your requests are being processed and, where necessary,  to keep track of the same. Once this period is over, Tixalia will keep such information blocked, for the period provided for by law, in order to deal with possible liabilities and in order to show compliance with our obligations. From then on, Tixalia will only process the information anonymously, so it will not be possible to link the statistical information with the specific users it refers to.
To whom do we disclose personal information? There is no additional disclosure for carrying out the processing other than those indicated, of a general nature, in point 4. To whom do we disclose your personal information? In this respect, some of the channels through which you can contact us are managed by service providers, who act as Data Processors. You will find further information on how these service providers act in the abovementioned point 4.

3.2.      When you sign up to our newsletter and other commercial communications:

What are the channels for gathering data? Commercial communications are carried out:
  • Based on our legitimate interest, as there is a prior contractual relationship between the parties in accordance with e-commerce conditions (LSSI); or
  • Based on your consent requested on registering in the specific form or ticking a corresponding box in the contact form.
What data do we gather? Identification and contact data: In order to send commercial information using electronic means, we use identification data (name) and the contact data you include in the corresponding form for signing up to our commercial communications. In the event that you have a contractual relationship with us, we will be entitled to use the data relating to your email in our possession on the basis of our contractual relationship.
What are the purposes of your personal data processing? To send commercial publications and communications relating to our products/services: by electronic means, we can send you our newsletter and other commercial communications related to our products and services.
What is the lawful basis on which we gather your data? Is it obligatory to provide these data? Commercial communications are carried out: ü  On the basis of our legitimate interest, as there is a prior contractual relationship between the parties in accordance with the E-commerce regulation (LSSI); or ü  On the basis of your consent, requested on your signing up in the specific form or ticking the corresponding box in the contact form You can unsubscribe from these commercial communications at any time using the mechanism indicated in each email or expressing your wish to unsubscribe in an email to rgpd@tixalia.com.
How long do we keep your data? In the event that commercial communications are sent on the basis of your consent, the information will be kept during the period of time in which you are subscribed in our list for the distribution of this kind of information and, once you unsubscribe, it will be blocked for the legal period provided for in order to deal with possible liabilities. In the event that the commercial information is sent on the basis of our contractual relationship, all your personal information will be kept for as long as it remains in effect. Once it is terminated, Tixalia will keep said information, blocked, for the period provided for by law, in order to deal with possible liabilities and demonstrate  compliance with our liabilities.
To whom do we disclose personal information? There are no specific disclosures of your personal data in order to comply with the purpose specified in this  section. Nevertheless, we can resort to the services of mail marketing service providers or other advertising and marketing service providers, who will have limited access to the data and will be bound by a duty of confidentiality (for further information on how our service providers  act, see point 4. 3.3.      Website navigation (cookies)

3.4.      Use of plug-ins or social complements:

When you use our services, you can share information on social networks, such as Facebook or LinkedIn, by implementing a social plug-in social (such as a “Share” button). If you choose to share information using a social plug-in, the following data will be transferred to the corresponding social network:

3.5.      Tixalia profiles in social networks.

Tixalia has a profile in the main social networks, such as Facebook, Twitter, Instagram, LinkedIn or YouTube. When you become a follower of any of our pages in social networks, the data processing will be governed by the conditions of use, privacy policies and access regulations belonging to the corresponding social network and previously accepted by the user. In this respect, Tixalia will process your data for the purpose of correctly administrating its presence in the social network, offering information on activities, products or services, as well as for any other purpose allowed by social network regulations. Remember that we have no influence on the information that the social network gathers or on how it processes it, which is why we recommend you keep informed of the purpose and scope of the gathering of information carried out through said social networks.

4.    TO WHOM DO WE DISCLOSE YOUR PERSONAL INFORMATION?

Generally speaking, we will not disclose your data to third parties from Tixalia. However, apart from the disclosures specified in the section in which we explained the features of the different operations (point 3), we inform you of the communications, of a general nature, we can make, and which affect all the previous processing and its lawful basis.

  1. Essential service providers to render the service we offer you (for example,  computer hosting companies or commercial communication delivery platforms). Notwithstanding the above, these bodies have signed the corresponding confidentiality agreements and will only process your data according to our instructions, their not being allowed to use them for their own purposes or apart from the service they provide us.
  2. Public bodies. We shall be entitled to reveal to the competent public authorities the data and any other information in our possession and accessible via our systems when there is a legal obligation to do so, as well as when it is required, for example, for the purpose of preventing or pursuing abuse of service or fraudulent activities through our Website or web page. In these cases, the data of a personal nature which you provide us with will be kept and placed at the disposal of the administrative or judicial authorities.

5.    ARE YOUR PERSONAL DATA TRANSFERRED TO THIRD COUNTRIES OUTSIDE THE ECONOMIC SPACE?

Some of our service providers are located in countries outside the European Economic Area (“EEA”). The location of these companies outside the EEA entails the need for an international transfer of your personal data, which implies a lesser degree of protection than that guaranteed by the European regulation. Nevertheless, from Tixalia, we have applied measures to ensure that said transfers do not lead to a lesser degree of protection of your personal data. In this respect, the service providers that are located outside the EEA have signed the corresponding standard contractual clauses approved by the European Commission (“CCT”), an agreement signed between both entities whereby the non-Community country guarantees that it applies European data protection standards. As a result, the use of these providers does not imply a lesser degree of protection of your personal data than that in the case of providers located in the European Union. 6.    WHAT RIGHTS CAN YOU EXERCISE AS AN INTERESTED PARTY?

You can exercise the rights guaranteed by law in relation to the processing of your personal data by contacting us  by email: rgpd@tixalia.com. Any rights request we receive will be settled as soon as possible and, in any event, within the maximum period of time laid down by law from the date of reception. In some cases, we will require a copy of your identity card or another identification document if we need to verify your identity. The rights corresponding to you as an interested party are as follows:

  2. You can withdraw your consent in relation to all the processing based on the same at any time. Nevertheless, withdrawal of consent shall not affect the legality of the processing based on the consent prior to its withdrawal.

  4. You have the right to know which data are subject to processing, where applicable, and, if such is the case, to obtain a copy of the same, as well as to obtain information relating to:
    • the origin and recipients of the data.

    • if an automated process of decision-making exists, including profiling.

    • the rights covered by the regulation.

  11. Right to the limitation of the processing of your personal data You have the right to the limitation of the processing of your data in the following cases:
    • When you have requested the rectification of your personal data during the period in which we verify the accuracy of the same.
    • When you consider that we are not authorised to process your data. In this case, you are entitled to request that we limit their use instead of requesting their erasure.
    • When you consider that it is no longer necessary for us to go on processing your data and you wish them to be retained by us for the purpose of exercising or defending a claim.
    • In the cases in which the processing is based on our legitimate interest and you have exercised your right to opposition to the same, you can request that we limit the use of your data during verification of the prevalence of said interests over yours.

  13. Right to lodge a complaint to the Supervisory Authority
    Remember that, at any time, and, in the event that you consider that we have infringed your right to data protection, you are entitled, in your defence, to address the corresponding Supervisory Authority, in Spain’s case, the Spanish Data Protection Agency (www.agpd.es).

7.    HOW DO WE GUARANTEE THE CONFIDENTIALITY OF YOUR INFORMATION?

The safety of your personal data is a priority for us. To this end, Tixalia has implemented all the necessary safety measures to guarantee efficient use and processing of personal data provided by the user, safeguarding the privacy, confidentiality and integrity of the same and uses the necessary technical means to avoid any alteration, loss, non-authorised access or processing of your data, in accordance with the state of technology at all times. Consequently, we meet the recommended safety standards to protect them. However, it is impossible to fully guarantee their safety due to the very nature of the internet and because fraudulent actions beyond our control may be carried by third parties. We undertake to act quickly and diligently in the event that the safety of the data is endangered or compromised and to inform you of the same in the event that it is important.

8.    MODIFICATIONS OF THIS POLICY

From Tixalia, we are entitled to modify the content of the privacy policy at any time, particularly when there are any modifications in legislation or case law or in the interpretation of the Spanish Data Protection Law that may affect the data processing carried out by Tixalia through this Website. Any new version of this Privacy Policy will come into force on the published date of entry into force. Should the revised version include any substantial changes that affect the data processing, we will inform you, at least, 30 days in advance by publishing a notification in our website or communicating it by email. Nevertheless, you are recommended to  periodically review this Privacy Policy to keep up to date on how your personal data is processed and protected, as well as with your existing rights.
